According to the Federal Law "On the Protection of Environment", the control in the sphere of environmental protection (Environmental Control) is the system of measures aimed at the prevention, uncovering and restraint of violations of the environment protection legislation, the compliance support of the entity involved in economic or other activities with the requirements including the standards and regulatory documents in the field of environmental protection. State, industrial and public environmental control is carried out on the territory of the Russian Federation.

The Authorities Performing the State Environmental Control. The State environmental control is carried out by federal executive bodies and executive government bodies of the constituent entities of the Russian Federation in accordance with the procedures established by the Government of the Russian Federation. Such procedure is determined by the resolution No. 53 of the Government of the RF dated 27.01.2009 "On Exercise of State Control in the Sphere of Environmental Protection (State Environmental Control)".

According to the Regulation on the Federal Supervisory Natural Resources Management Service approved by the resolution No. 400 of the Government of the RF dated 30.07.2004, the Federal Supervisory Natural Resources Management Service (Rosprirodnadzor) is a federal executive body that performs the State environmental control (Federal state environmental control). By the resolution No. 716 of the Government of the RF dated 25.09.2008, the officials of the Federal Supervisory Natural Resources Management Service and its territorial bodies that perform federal state environmental control (Federal state environment protection inspectors) were appointed.

According to the Regulation on the Committee for Use of Natural Resources, Environment Protection, and Environmental Safety approved by the resolution No. 530 of the Government of Saint-Petersburg dated April 06, 2006, the Committee performs the State control in the sphere of environmental protection (State environmental control) over the objects of economic or other activities irrespective of their form of ownership that are situated on the territory of Saint-Petersburg except for the objects of economic or other activities subject to the Federal state environmental control.

The Objects Subject to the Federal State Environmental Control. The list of the objects subject to the Federal state environmental control is determined by the Resolution No. 285 of the Government of the Russian Federation dated March 31, 2009.

Rights of State Environment Protection Inspectors. In accordance with the requirements of the Federal Law "On the Protection of Environment", the state environment protection inspectors in the discharge of their duties within their power have duly the right to:

• Visit for the purpose of control the organizations, objects of economic or other activities irrespective of their form of ownership including the facilities which are subject to State protection, defense facilities, civil defense facilities; to study documents and other materials necessary to perform the State environmental control;
• Verify the compliance with environmental regulations, State standards and other regulatory documents, the operation of waste treatment plants and other detoxifying facilities, inspection means and the execution of environmental plans and measures;
• Check the compliance with environmental requirements, norms and regulations at deployment, operation and retirement from service of industrial and other facilities;
• Control the execution of the requirements specified in the conclusion of State environmental expertise and make suggestions for its conducting;
• Make demands and issue instructions to legal and individual persons to eliminate the environmental law violations and violations of environmental requirements, identified at the execution of State environmental control;
• Institute administrative proceedings against the persons who commit the violations of the environment protection legislation;
• Perform other duties determined by the legislation.

Responsibilities of State Environment Protection Inspectors. Federal State inspectors and State inspectors of the constituent entities of the Russian Federation in the environment protection sphere are obliged to:

• Prevent, identify and restrain the violations of the environment protection legislation;
• Explain to violators of the environment protection legislation their rights and responsibilities;
• Satisfy requirements of the legislation.

Decisions of state environment protection inspectors may be appealed in accordance with the Legislation of the Russian Federation.
The State environmental control is organized and executed in closed administrative territorial units, sensitive, extra sensitive facilities and high-security objects of the Armed Forces of the Russian Federation.

By the Resolution No. 461 of the Government of the Russian Federation dated May 18, 1998, the special procedure is determined concerning the organization and execution of the State environmental control in closed administrative territorial units, sensitive, extra sensitive facilities and high-security objects of the Armed Forces of the Russian Federation as well as the State environmental expertise of weapons and military equipment, military facilities and activity. First of all, this special procedure deals with the procedure for admittance of the authorized officials performing the State environmental control to the objects of the Armed Forces of the Russian Federation.

The Object of the State Environmental Control. In a general case, the object of the state environmental control is:

• compliance with environmental regulations, state standards and other regulatory documents, the operation of waste treatment plants and other detoxifying facilities, inspection means as well as the execution of environmental plans and measures;
• compliance with environmental requirements, norms and regulations at deployment, operation and retirement from service of industrial and other facilities;
• control of the requirements execution specified in the conclusion of State environmental expertise;
• timelines and completeness of charges for negative impact on the environment;
• organization and execution of industrial environmental control including analytical (instrumental) control and presence of the officials responsible for its conducting;
• execution of the previously issued instructions to rectify violations of the requirements of the Legislation of the Russian Federation.
  Control Measures. Within the framework of the control measures the following actions are performed:
• field inspection of the object (objects);
• document order, as well as in accordance to the procedures established by the Article 26.10 of the Code of the Russian Federation on Administrative Violations;
• office work with the presented documentation (examination, analysis, forming of conclusions and building of positions).
